About these terms
In these terms, "FinTaxPort", "we", and "us" mean our firm; "you" means a visitor to the website or a client; and "services" means the tax, GST, accounting, registration, and compliance work we agree to do for you.
Where we have given you a separate engagement letter or written quote, its terms apply to that engagement and take priority over these terms if the two differ.
Our services
The scope of each engagement is what we confirm to you in writing, by email, quote, invoice, or engagement letter. Work outside that scope, such as new notices, additional years, or additional entities, will be quoted separately.
Service descriptions, prices, and timelines on the website are indicative and given for general guidance. They are confirmed only once we have reviewed your facts and documents.
Your responsibilities
To let us do the work properly and on time, you agree to:
- Give us complete, accurate, and true information and documents.
- Send documents in good time before the due date. We are not responsible for late fees, interest, or penalties caused by information that reaches us late or incomplete.
- Review drafts we share and confirm them before filing. Returns and applications are filed on your approval, and you remain responsible for the contents of filings made in your name.
- Keep your passwords, one-time codes, and digital signature certificates safe.
- Tell us promptly about any notice you receive or any change in your circumstances.
- Upload or share only documents that you are entitled to share.
Fees, invoices, and payment
Our fees are as quoted for each engagement. GST is charged in addition at the applicable rate.
We raise invoices through the client portal or by email. Invoices are payable within the time stated on them. We may pause work or hold back a filing while an invoice is overdue, and will try to tell you in advance where a due date could be affected.
We may change our prices for new engagements at any time. Agreed fees for work already in progress do not change without your consent.
Government fees and other charges
Government fees, stamp duty, late fees, interest, penalties, digital signature charges, and other third-party costs are separate from our professional fees. You pay them directly or reimburse them to us at actual cost.
Timelines and outcomes
Timelines we give are estimates. They depend on when we receive complete documents, on government portals being available, and on how quickly authorities process applications. We do not control the authorities.
We work with due care, but we cannot guarantee any particular outcome, such as the approval of an application, the amount or timing of a refund, the result of an assessment, or the registration of a trademark.
Confidentiality
We keep your information confidential. We disclose it only to government authorities as needed to carry out your service, to people working with us on your matter, or where the law requires it. Our Privacy Policy explains how we handle personal data.
Client portal and accounts
Portal accounts are for our clients. When you use the portal:
- You are responsible for activity under your account; do not share your sign-in details.
- Do not upload harmful files or try to access data that is not yours.
- We may suspend an account that is misused, or where invoices remain unpaid.
- The portal may sometimes be unavailable for maintenance or for reasons beyond our control. Please keep your own copies of important documents.
Limitation of liability
To the extent permitted by law, our total liability for any claim arising from an engagement is limited to the professional fees you paid us for the specific service that gave rise to the claim.
We are not liable for indirect or consequential loss, or for loss caused by information that was inaccurate, incomplete, or late, by the actions or delays of authorities, by outages of government portals, or by events beyond our reasonable control. Nothing in these terms limits any liability that cannot be limited under law.
Website content
The content of this website belongs to FinTaxPort and may not be copied for commercial use without our permission. Documents we prepare for you may be used for your own purposes.
Ending an engagement
Either of us may end an engagement by written notice. Fees for work done up to that point remain payable, as set out in our Refund Policy.
We may stop work if information given to us turns out to be false, if fees remain unpaid, or if continuing would breach the law or professional standards. When an engagement ends, we will return the documents you provided, subject to any records we must keep by law.
Governing law and disputes
These terms are governed by the laws of India. We will first try to resolve any dispute through discussion; please write to us at info@fintaxport.com. If a dispute cannot be resolved, the courts at Jaipur, Rajasthan will have exclusive jurisdiction.
Changes to these terms
We may update these terms from time to time. The date at the top shows when they were last changed. The version in force when you engage us applies to that engagement.
